These Terms and Conditions are intended to protect both the customer and Danushka Gems and Minings, especially because gemstones, rough stones, crystals, specimens, and custom gemstone services involve natural variation, individual evaluation, specialized handling, and in many cases one-of-a-kind material.

1. Introduction

These Terms and Conditions govern your access to and use of our website, your communications with us, and any inquiry, reservation, sourcing request, purchase, payment, shipment, certification request, custom cutting request, or other transaction made with Danushka Gems and Minings.

By accessing this website, contacting us, requesting gemstone information, placing an order, making payment, or otherwise using our services, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you should not use this website or proceed with a transaction.

These Terms and Conditions are intended to protect both the customer and Danushka Gems and Minings, especially because gemstones, rough stones, crystals, specimens, and custom gemstone services involve natural variation, individual evaluation, specialized handling, and in many cases one-of-a-kind material.

2. About Our Business

Danushka Gems and Minings is a Sri Lanka-based gemstone business focused mainly on natural gemstones sourced through direct mining connections, direct suppliers, and long-term trusted source relationships. Our work is built around natural gemstone material, especially facet-grade rough, crystals, specimens, and selected cut stones, depending on availability and customer requirements.

We may source from different gemstone-producing regions in Sri Lanka, including but not limited to Ratnapura, Rakwana, Nivithigala, Kalawana, Pelmadulla, Endana, Rambuka, Kuruwita, Wellawaya, Elahera, Kolonna, Kataragama, and other source-connected mining regions and villages. We may also work with directly sourced gemstone material from other countries through trusted individual suppliers, miners, and long-term source relationships, depending on gem type and availability.

Our business model is relationship-based and source-based. We do not depend mainly on open gem markets as our primary supply model. Instead, we work closely with trusted individuals, direct mining contacts, and long-established supplier relationships.

3. Eligibility to Use the Website and Services

By using this website or entering into a transaction with us, you represent that you are legally capable of entering into a binding agreement under the laws applicable to you. If you are acting on behalf of a business, company, partnership, or other entity, you represent that you have authority to bind that entity to these Terms and Conditions.

You agree to provide accurate, current, and complete information when communicating with us, making an inquiry, requesting a payment link, placing an order, or arranging delivery.

4. Nature of Products

Danushka Gems and Minings deals in natural gemstones and gemstone-related materials. These may include, depending on availability, rough gemstones, facet-grade rough material, natural crystals, mineral and gemstone specimens, cut and polished gemstones, custom-cut gemstones prepared from selected material, gemstone parcels, collector pieces, reference stones, and certified stones where available or requested.

Because these are natural materials, every stone is unique. No two gemstones are exactly the same in color, tone, internal structure, shape, inclusions, surface condition, growth marks, zoning, transparency, or cutting potential.

All natural stones may show characteristics that are part of their geological formation. These may include inclusions, silk, fractures, healed fissures, surface marks, growth lines, zoning, color variation, oxide staining, alluvial wear, twin growth, crystal irregularity, and other natural features. Such features are not automatically defects. They are often part of the natural identity of the stone.

5. Product Information and Descriptions

We aim to describe and present all stones honestly and professionally. Product descriptions, social media posts, videos, voiceovers, website listings, captions, certificates, and replies are provided in good faith based on our experience, our records, supplier information, visual examination, and any available gemological information.

However, gemstone descriptions are not a guarantee that every viewer will interpret color, clarity, or potential in the same way. Visual appearance may vary due to lighting conditions, sunlight versus indoor light, transmitted light versus reflected light, camera settings, screen calibration, display brightness, compression on social media platforms, angle of viewing, stone orientation, magnification level, and background color.

Measurements and carat weight are provided as accurately as reasonably possible, but minor differences can occur depending on tools, re-checking, mounting status, recutting, polishing, or laboratory measurement standards.

Any discussion of cutting potential, yield, orientation, clarity improvement, treatment possibility, or final appearance is opinion-based and process-based unless expressly stated as a guaranteed outcome in writing. Natural rough and crystal materials must always be evaluated individually.

6. Origin Statements and Source Information

Where we state an origin, locality, or source area, such as a Sri Lankan village-level mining region or another country of origin, that statement reflects our sourcing records, direct source understanding, supplier information, transaction history, or laboratory documentation where available.

Unless an independent gemological laboratory report specifically confirms geographic origin, origin statements on the website or in direct communication should be understood as source-based trade descriptions rather than an absolute scientific guarantee.

When we refer to stones as sourced directly, directly connected to mining areas, or supplied through trusted long-term contacts, this reflects our business model and sourcing relationships. It does not necessarily mean that every stone comes from a miner to us without any intermediate handling; it means the supply chain is relationship-based and source-trusted rather than mainly open-market based.

7. Availability and Inventory

All stones and parcels are subject to prior sale, private reservation, source confirmation, and final verification. Because we often work with unique and irregular natural material, availability can change quickly.

A listing, photo, or conversation does not guarantee continued availability until we confirm the stone is still available and, where applicable, payment or deposit requirements have been met.

We reserve the right to update, withdraw, reserve, or remove any product, listing, parcel, or offer at any time, including where the item has been sold, the item has been reserved, the item is under review, the item is no longer available from source, there is a pricing or description error, there is a compliance, shipping, or handling issue, or the customer has delayed confirmation beyond a reasonable time.

8. Prices and Currency

All prices shown on the website, in messages, invoices, social media posts, quotations, or direct communication are subject to change without notice until an order is confirmed.

Prices may be affected by source cost changes, rarity and demand, exchange rate movements, cutting or certification requests, courier cost changes, taxes or duties, payment gateway fees, handling requirements, and market conditions.

Unless stated otherwise, prices do not automatically include certification, custom cutting, customs duties, local taxes in the destination country, import fees, broker fees, wire-transfer charges, gateway charges, PayPal charges, or special shipping requests.

If a pricing error occurs, we reserve the right to correct it before shipment or performance of service.

9. Orders, Reservations, and Holds

Some stones may be held or reserved for a short period by agreement. Because natural stones are unique and often requested by multiple buyers, a hold or reservation is not indefinite unless we confirm it in writing.

We may cancel a hold or release a reserved stone if payment is not received within the agreed period, the customer becomes unresponsive, the sourcing context changes, the stone becomes unavailable for reasons beyond our control, or the reservation creates commercial loss without commitment.

For custom requests, source-based holds, cutting requests, and specially selected stones, we may require payment in advance before proceeding, especially where committing the stone to one customer means losing other sale opportunities.

10. Payment Terms

We may accept payment through approved channels such as website payment gateway, card payment link, bank transfer-related arrangements, Wise or similar transfer methods where available, Western Union, MoneyGram, Ria, or similar methods where accepted, PayPal where accepted, and other payment channels we approve at the time.

The available payment methods may change.

The customer is responsible for providing accurate payer details, paying the full agreed amount, covering applicable transfer or payment fees where agreed, ensuring funds arrive in the correct currency and amount, and completing payment within the agreed timeline.

We reserve the right to refuse or cancel a transaction if payment is incomplete, delayed, suspicious, reversed, disputed, or fails compliance checks.

No order is considered fully confirmed until cleared payment has been received or until we expressly confirm otherwise in writing.

11. Custom Sourcing Requests

Many customers ask us to search for a specific gemstone based on size, shape, color, clarity, treatment status, budget, origin, intended jewelry use, or cutting style. We are happy to assist with this type of sourcing, but all sourcing is subject to natural availability and source conditions.

A sourcing request does not guarantee that we will find the exact stone requested.

If we allocate time, source effort, or a specific stone to a custom sourcing request, we may require advance payment, a sourcing deposit, time-limited confirmation from the customer, and final approval before moving to the next stage.

Deposits or advance payments related to specific sourcing work may be non-refundable once sourcing activity, reservation, or source commitment has begun.

12. Cutting, Pre-Forming, and Custom Production

Some customers buy stones in natural form and request cutting, pre-forming, polishing, calibration, recutting, or other production work from our side.

All custom cutting and related production work is subject to the natural structure of the stone, internal inclusions or zoning, yield limitations, shape limitations, color distribution, cutter judgment, the realistic behavior of the material, and the customer’s approved direction.

Any estimate about possible finished size, finished weight, clarity improvement, design outcome, or final face-up appearance is an estimate only unless expressly guaranteed in writing.

Once custom cutting, pre-forming, polishing, drilling, carving, certification, mounting, or other customer-requested alteration begins, the order is generally treated as final and non-cancelable.

We are not responsible for dissatisfaction based purely on a customer’s changed taste after approved custom work has been completed according to the agreed direction.

13. Treatment, Enhancement, and Disclosure

We aim to disclose treatment status honestly based on our knowledge, available records, and any laboratory documentation available at the time.

Where a stone is described as unheated, natural, heated, standard heated, or otherwise treated, that description reflects the information reasonably available to us at the time of listing or sale.

Some stones may be offered in natural condition with discussion of possible treatment paths as part of professional evaluation. Any such discussion is informational and does not mean that a specific treatment result is guaranteed.

Unless specifically agreed in writing, we do not guarantee that treatment will improve a stone, that color will strengthen in a particular way, that inclusions will become less visible, that the final result will match an example image, or that a treatment recommendation is suitable for every stone.

If the customer requests treatment or approves treatment-related work, the customer accepts the material risk involved in that process.

14. Certificates and Gemological Reports

Certificates or gemological reports may be provided where already available or may be arranged at the customer’s request, depending on the stone and the laboratory option selected.

Unless stated otherwise, certification cost is separate, certification adds time to order completion, laboratories use their own methodologies and wording, different laboratories may not use identical terminology, and locality or treatment results in reports are subject to the lab’s own findings.

We are not responsible for differences in wording, terminology, grading style, or interpretation between one laboratory and another.

If the customer requests certification after purchase or as part of a custom order, that service may be non-refundable once submitted to the laboratory.

15. Photos, Videos, Reference Images, and Example Stones

We may provide photos and videos in different lighting conditions, including daylight, indoor light, fluorescent light, spotlight, mixed light, transmitted light, and neutral light, depending on the purpose of evaluation.

Where we show a previously cut stone, sample image, or reference image, it is for visual direction only unless we expressly state that the exact stone shown is the one being sold.

A reference image is not a guarantee that another rough stone will produce an identical result.

Customers are expected to understand that rough stones and crystals behave differently after cutting, color may shift depending on orientation and depth, inclusions may become more or less visible after cutting, and comparison media are approximate aids, not exact promises.

16. Shipping and Delivery

We may arrange shipment for selected items, including natural crystals, specimens, cut pieces, and other items we agree to dispatch, using available courier and logistics channels.

Shipment methods may vary by item type, value, destination country, courier availability, customs requirements, current transport conditions, insurance availability, and packaging needs.

Estimated shipping times are approximate and not guaranteed.

We are not responsible for delays caused by customs processing, courier backlog, airline delays, weather, war or regional instability, government restrictions, strikes, documentation checks, destination-country clearance procedures, or force majeure events.

The customer is responsible for providing an accurate shipping name, address, phone number, email, and any other information required for delivery.

If a package is delayed, held, or returned because of incorrect customer information, the customer remains responsible for the consequences and any additional cost.

17. Customs, Import Rules, Duties, and Destination Compliance

The customer is responsible for understanding and complying with the import rules, customs requirements, taxes, duties, brokerage fees, and regulatory conditions of the destination country.

We do not guarantee that every item can be imported into every country under every circumstance. Acceptance of an order does not remove the customer’s responsibility to understand the rules of the destination.

If customs authorities request documentation, clarification, inspection, tax payment, or additional procedures, the customer is responsible unless we have expressly agreed otherwise in writing.

We are not responsible for losses arising from destination-country import restrictions, customs seizure unrelated to our misdescription, customer refusal to pay duties or taxes, incomplete customer import documentation, or delays caused by destination regulations.

18. Transfer of Risk

Ownership of goods does not pass until full cleared payment has been received.

Risk in shipped goods passes to the customer upon delivery to the address provided, or upon the first delivery attempt where the package is available for receipt, unless otherwise required by law.

If the customer asks us to use a specific shipping method, route, or uninsured arrangement, the customer accepts the related shipping risk to the extent permitted by law.

Any transit issue must be reported promptly, with clear unpacking evidence where possible.

19. Inspection on Arrival

The customer should inspect the parcel promptly upon receipt.

If the customer believes the wrong item was sent, the parcel arrived visibly damaged, the shipment contents are missing, or the item materially differs from what was agreed, the customer should notify us in writing within a reasonable time, ideally within 48 hours of delivery.

The customer should include clear photos, packaging photos, shipping label photos, unboxing evidence where available, and a clear explanation of the issue.

Failure to report promptly may affect our ability to review the claim or pursue a courier claim.

20. Returns, Refunds, and Exchanges

Because natural gemstones are unique and many items are selected individually, returns are limited.

Returns, refunds, or exchanges may be considered only where the wrong item was sent, there is a verified material misdescription, there is verified transit damage supported by evidence, or the issue is clearly attributable to our error.

We generally do not accept returns or refunds for change of mind, personal preference after delivery, differences caused by lighting or screen appearance, minor natural inclusions or surface features already visible or reasonably expected, customer misunderstanding of natural gemstone behavior, custom-sourced stones, custom-cut stones, customer-approved stones after cutting or certification has begun, items altered, mounted, damaged, or used after receipt, or orders delayed by customs or destination-country procedures outside our control.

If a return is approved, the item must be returned in the same condition in which it was received, using the method we instruct. Unauthorized returns may be refused.

Where a refund is approved, it may be reduced by non-recoverable costs such as courier charges, payment gateway fees, banking fees, laboratory fees, custom work already performed, and taxes not recoverable by us.

21. Cancellations

Orders may be canceled only before we commit to sourcing, reservation, processing, certification, or production.

Once a stone has been specially sourced, reserved specifically for the customer, submitted for certificate, sent for cutting or preparation, packed and dispatched, or otherwise committed to the customer’s order, the transaction may become non-cancelable.

If a cancellation is accepted before commitment, refunds may still be subject to non-recoverable payment or administrative fees.

22. Chargebacks and Payment Disputes

Customers agree not to initiate unfair or bad-faith chargebacks or payment reversals.

If a customer has a genuine issue, the customer must first contact us and allow a reasonable opportunity for review.

Where a chargeback or payment dispute is filed after confirmed shipment, custom work, certification, or customer-approved sourcing, we reserve the right to provide all relevant evidence to the payment provider, including messages, invoices, payment records, photos and videos, shipping proof, laboratory receipts, customer approvals, and delivery records.

23. No Investment Guarantee and No Appraisal Guarantee

Unless expressly stated in a separate signed document, stones sold by Danushka Gems and Minings are not sold with a guaranteed resale value, guaranteed appreciation, guaranteed investment return, or guaranteed third-party valuation outcome.

Any educational or opinion-based discussion about rarity, beauty, source quality, treatment status, or market interest does not constitute financial advice or a guarantee of future value.

Any estimated cutting potential, commercial potential, or market appeal remains opinion-based unless separately guaranteed in writing.

24. Educational, Astrological, and Informational Content

From time to time, we may share educational content about gemstones, origins, crystal structure, birthstones, astrology-related traditions, folklore, historical information, or general gemstone culture.

Such content is for general informational, cultural, and commercial context only. It is not medical advice, legal advice, financial advice, or a guarantee of metaphysical outcome.

25. Intellectual Property

All content on this website and in our business materials, unless otherwise stated, belongs to Danushka Gems and Minings or is used with permission. This includes, without limitation, product photos, gemstone videos, parcel videos, captions, descriptions, voiceovers, website text, logos, branding elements, design layout, reference compilations, custom images, and product naming formats.

You may not copy, reproduce, republish, scrape, redistribute, modify, download for resale, or commercially use our content without our prior written permission.

Using our media to misrepresent source, treatment, ownership, or availability is strictly prohibited.

26. User Conduct

30. Limitation of Liability

To the fullest extent permitted by law, Danushka Gems and Minings shall not be liable for indirect, incidental, consequential, special, punitive, or speculative losses arising from natural variation in gemstones, customer interpretation of photos or videos, treatment uncertainty, cutting uncertainty, market value changes, customs delays, courier delays, destination-country import issues, events outside our reasonable control, third-party service failures, or customer misuse or mishandling after delivery.

Our maximum liability in relation to any claim shall generally be limited to the amount actually paid to us for the specific item or service directly giving rise to the claim, except where a different limit is required by law.

Nothing in these Terms and Conditions excludes liability that cannot be excluded under applicable law.

31. Indemnity

You agree to indemnify and hold harmless Danushka Gems and Minings, its owners, representatives, contractors, and service partners from losses, claims, damages, liabilities, and costs arising out of your breach of these Terms and Conditions, inaccurate information provided by you, your misuse of the website, your violation of third-party rights, your failure to comply with import, tax, or customs rules in your destination country, or your unauthorized reuse of our content or media.

32. Force Majeure

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to war, civil unrest, regional instability, fuel shortages, natural disasters, strikes, border disruptions, pandemics, government action, embargoes, transport disruption, communication breakdown, power failure, internet outage, and source-area closures.

In such circumstances, we may suspend, delay, or cancel affected obligations without liability beyond refunding any amount we consider fairly refundable after deducting unavoidable committed costs.

33. Severability

If any part of these Terms and Conditions is found invalid, illegal, or unenforceable, the remaining provisions shall continue in full force to the maximum extent permitted by law.

34. No Waiver

Our failure to enforce any provision of these Terms and Conditions on one occasion does not mean we waive the right to enforce it later.

35. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any specific written invoice, quotation, certificate arrangement, payment instruction, or custom-work confirmation, form the entire agreement between you and Danushka Gems and Minings regarding the relevant transaction.
